Thanks Again, San Francisco
Back in the distant past of a few weeks back when the San Francisco city fathers hotly debated the terrible burden of having blue painted airplanes darken their skies, a commenter over here asked why we were bashing their fair city.
This week, it’s because they need a few Marines walking the streets.
Oh, by the way, the Blue Angels will be in Salinas this weekend. Salinas isn’t as frou-frou as San Fran, but they somehow manage to gather excitement for the show.

I think the proper response for the Marines is to go to their friendly JAG office and ask for the city to be sent a letter asking them to reconsider, and reminding them:
A. The power to condemn private property by the process of eminent domain is an inherent attribute of sovereignty. Boom v. Patterson, 98 U.S. 403, 406 (1878). Translation: WE GET TO DO THIS.
B. A condemnation proceeding is in rem; it is against the thing; hence the style, United States v. 21.21 Acres…..not US v Whack-jobs. But that also means no using “Jones Street” as the rallying cry.
C. Federal substantive (40 U.S.C.A. § 258a) and procedural (Rule 71A, Fed.R. Civ. P.) law apply; state condemnation law and procedure are irrelevant. See, United States v. Miller, 317 U.S. 369, 380 (1943). Even the Guv can’t touch this. Unless he really IS a cyborg sent from the future. Then maybe. But I doubt he is. Calif. would have regulated his exhaust emissions long ago and he’d have a catalytic converter or something.
D. Once the condemnation case is filed, the federal district court is without jurisdiction to expand the estate taken. Sweet v. Rachel, 159 U.S. 380, 395 (1895). Once they say “We’re taking this”, there’s no changing that. Done and done!
Would that solve the problem?

Oh, goodgodalmighty! The Blue Angels are fun to watch! Their killin’ skillz also are entertaining when displayed in public.
Except that those aren’t their killin skilz, more like their ballet skillz.
Dammit! I like to watch people fly airplanes in fun ways, and military airplanes are the most fun to watch being flown in fun ways.

The Angels were at Salinas this weekend. Salinas is a farming community being encroached upon by Monterey and San Jose. So they liked the planes coming in to the Municipal Airport!
Over in Carmel Valley, a little more expensive and not far down the road, they had a big $500/person bash where writers spoke: Elizabeth Edwards, Sy Hersh, et cetera. I guess they didn’t have a municipal airport…
